Wayne did a fabulous job outlining the Kafkaesque dark side of the vaccine court. Wayne’s stories insights and comments stayed with me all night. Funny, the song lyrics to the 1940 American patriotic folk song “This is my country…” popped into my head for the first time in decades. Sadly, I wondered what our country has done to us.

This radio show is not about being pro-vaccine or vaccine educated (the term I prefer to use instead of the derogatory ‘anti-vaccine’ slander.), it is about justice. Parents if you are going to get your children – or yourselves vaccinated make sure you know you are protected by your government. Make sure your government offers you a just and fair appeal in case you or your child has an adverse event post-vaccination. This show is about justice. And our government falls short of offering the families – who played by their rules and who are now paying the price – compensation while the government sits on a $3.5 billion trust fund (collecting interest and getting a 25% cut annually) that was originally set up to assist families with their new burden of financial needs.

Join friend and colleague, and father of a vaccine-injured child, Wayne Rohde and myself for an informative interview on his latest book, The Vaccine Court- The Dark Truth of America’s Vaccine Injury Compensation Program.
There are courts for just about everything – but most Americans are not aware there is a Vaccine Court. How did this evolve? In 1986 Congress created the National Childhood Vaccine Injury Act. Sounds good on paper – but as Wayne will discuss there is a dark side to this ‘justice. So what is the vaccine court? It is a federal claim’s court that deals specifically with vaccine cases where families can go for injury compensation if their child is injured by a vaccine.
The National Vaccine Injury Compensation Program (NVICP) – although at first glance a relief for vaccine injured, was not designed with the welfare of the American public in mind. The vaccine court was in fact created as a ‘no-fault compensation program to protect pharmaceuticals companies from being sued by parent’s of brain-injured children as a result of compulsory childhood vaccines. The claims are managed and adjudicated by the congressionally created Office of Special Masters, which consists of eight special masters appointed to serve for four year terms.
During the 1980’s juries in these cases were found to be more sympathetic with the plaintiffs and in October 1988 because the U.S. government, who also has a vested interest in the pharmaceutical ‘golden egg’ vaccine industry, Congress passed the Vaccine Act that on one hand effectively protects pharmaceutical companies while on the other hand collects a tax (.75 per dose; $2.25 per 3-dose vaccine such as MMR) on medical consumers to pay for vaccine death and injury.
It appears that the public is not only not aware of the ‘obscure’ court – ruled over by even more ‘obscure’ special masters who make the final decision on whether or not a vaccine-injury award is granted – and on the amount of compensation received. In fact, NVICP was developed with distinct guidelines that require cases to be adjudicated within 240 days with a 150 day extension. As Health Impact News reported in their September 17th, 2014 article, How the Government has Earned $3.5 BILLION from the Claim that Vaccines Don’t Cause Autism, many of those cases have taken years to settle – up to 11 years for one family. There is a limit of $250,000 compensation for death, however compensation in the millions have been awarded to vaccine-injured plaintiffs.
But the dark side gets even darker. According to ABA Journal Vaccine court is profitable for some lawyers, who get paid win or lose, “Private lawyers have been paid more than $60 million for cases they lost in a national vaccine court that hears vaccine compensation claims contested by the federal government.”
The Vaccine Court looks at the mysterious and often unknown world of the National Vaccine Injury Compensation Program (NVICP), the only recourse for seeking compensation for those who have been injured by a vaccine. The NVICP, better known as the ”Vaccine Court,” however, is not without controversy.
Established by Congress as a direct result of the passage of the National Childhood Vaccine Injury Act of 1986, the NVICP was supposed to offer a no-fault alternative to the traditional injury claims filed in state or federal courts and was to provide quick, efficient, and fair compensation for those who have been injured by vaccines. The reality, however, is that many cases take several years or longer to complete and require tremendous commitment from families already pushed to the brink of bankruptcy caring for the vaccine-injured family member, only to discover that the end result is manipulated by the government in defense of the US vaccine policy.
Mr. Rohde looks into the inner workings of the US Federal Claims Court and the NVICP. He interviews families who have filed petitions and won compensation, families who have been denied compensation, and families still waiting for a decision. By highlighting the journeys of these families—their efforts to find attorneys willing to represent them, the filing of their petitions, and the subsequent mountain of paperwork, medical records, and other documents that span years—Mr. Rohde exposes the bitter truth behind the NVICP. Through his thoughtful interviews and fact-finding research, The Vaccine Court sheds light on how the NVICP has evolved into something far more treacherous than what Congress envisioned with the National Childhood Vaccine Injury Act in 1986.
